Duty Solicitor at the Station

If you are arrested and taken to a police station, you have the absolute right to speak to a duty solicitor — free of charge, at any time of the day or night.

What is a duty solicitor?

A duty solicitor is an independent, qualified criminal defence lawyer who is available around the clock at police stations. They are entirely free — funded by the Legal Aid scheme — and are completely independent of the police.

What does the duty solicitor do for you?

Advises you on your rights before any interview begins
Reviews the evidence the police intend to put to you
Advises on whether to answer questions, remain silent, or make a prepared statement
Is present with you throughout the interview
Challenges any unlawful procedures or treatment
Advises on bail conditions if you are released

When should I ask for a duty solicitor?

Immediately. The moment you arrive at the police station, tell the custody officer ‘I want to speak to a solicitor.’ The police must then arrange access to a solicitor before any interview can proceed.

Can the police refuse?

No. Your right to legal advice is absolute. In very rare circumstances, a senior officer may delay (not deny) access for serious offences — but this is exceptional. We will challenge any unlawful delay.
